Welcome to IronMentor. These Terms of Service ("Terms") govern your access to and use of the IronMentor mobile application ("App"), services, and website (collectively, the "Services") provided by IronMentor, Inc. ("IronMentor," "we," "us," or "our").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.
1. Acceptance of Terms
By creating an account, accessing, or using IronMentor, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Eligibility
You must be at least 18 years old to use IronMentor. By using the Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.
3. Description of Services
IronMentor provides AI-powered fitness coaching services, including:
- Exercise Form Analysis: Video-based analysis of your exercise technique using artificial intelligence
- Personalized Recommendations: AI-generated exercise suggestions based on your fitness goals and medical history
- Progress Tracking: Tools to monitor your fitness journey over time
- Educational Content: Exercise tutorials, tips, and fitness information
4. Account Registration
To use certain features of the Services, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
5. Subscription and Payment
5.1 Subscription Plans
IronMentor offers various subscription plans. Details about pricing, features, and billing cycles are available within the App.
5.2 Payment
- Payment is processed through our third-party payment processors
- By subscribing, you authorize us to charge your selected payment method
- All fees are non-refundable except as required by law
5.3 Cancellation
- You may cancel your subscription at any time through your account settings
- Cancellation takes effect at the end of the current billing period
- You will retain access to paid features until the end of your billing period
6. User Conduct
You agree not to:
- Use the Services for any illegal purpose
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Upload malicious software or harmful content
- Attempt to gain unauthorized access to our systems
- Interfere with the proper functioning of the Services
- Use automated systems to access the Services without permission
- Impersonate any person or entity
7. Medical Disclaimer
7.1 Not Medical Advice
IronMentor is not a medical service. The information and recommendations provided through our Services are for general fitness purposes only and do not constitute medical advice, diagnosis, or treatment.
7.2 Consult Healthcare Providers
Before starting any exercise program, you should:
- Consult with a qualified healthcare provider
- Disclose any medical conditions, injuries, or limitations
- Get clearance for physical activity if you have any health concerns
7.3 AI Limitations
Our AI-powered recommendations are based on the information you provide and general fitness principles. The AI:
- Cannot replace professional medical judgment
- May not account for all individual health factors
- Should be used as a supplement to, not a replacement for, professional guidance
8. Intellectual Property
8.1 Our Content
All content, features, and functionality of the Services, including but not limited to text, graphics, logos, and software, are owned by IronMentor and protected by intellectual property laws.
8.2 Your Content
You retain ownership of content you submit (such as videos). By submitting content, you grant IronMentor a non-exclusive, worldwide, royalty-free license to use, process, and analyze such content solely for providing the Services.
9. Privacy
Your use of the Services is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information, including health data and video recordings.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- IronMentor shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid for the Services in the twelve (12) months preceding the claim
- We are not liable for any injuries resulting from exercise activities, even if following our recommendations
11. Indemnification
You agree to indemnify and hold harmless IronMentor and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any rights of third parties
- Any injury or harm resulting from your exercise activities
12. Modifications to Terms
We may modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the Services after changes constitutes acceptance of the modified Terms.
13. Termination
We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion. Upon termination, your right to use the Services ceases immediately.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
15. Dispute Resolution
Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
